AfriEv Terms of Service

1. INTRODUCTION

Welcome to AfriEv.

AfriEv is an event technology platform designed to help organizations and individuals create, manage, promote, administer and verify events and event-related activities.

Depending on the services enabled, AfriEv may provide:

• event creation, websites, and custom branded event pages;
• event registration, ticketing, and invitation systems;
• participant management, attendee management, and role accreditation;
• QR-code check-in, attendance tracking, and session management;
• volunteer management, speaker management, sponsor and exhibitor management;
• certificate issuance, certificate verification, and digital credentials;
• event communications, payment processing, reporting, and live analytics;
• organization dashboards, APIs, webhooks, and third-party integrations;
• event discovery, digital event participation, and event administration.

These Terms of Service ("Terms") govern your access to and use of AfriEv. By creating an account, registering for an event, purchasing a ticket, using an AfriEv service, accessing an AfriEv event page, accepting an invitation, using a digital credential, or otherwise using AfriEv, you agree to these Terms and any applicable policies incorporated into them. If you do not agree with these Terms, you should not use the relevant AfriEv services.

2. IMPORTANT LEGAL NOTICE

These Terms form a legally binding agreement between you and the applicable AfriEv legal entity. However, certain services may also involve a separate legal relationship between you and an event organizer.

For example, if you register for a conference organized by an independent organization through AfriEv:

• AfriEv provides the underlying software technology;
• the organizer determines event rules, admission requirements, and ticket prices;
• the organizer determines cancellation policies, eligibility, content, and operations.

Accordingly, not every dispute relating to an event is necessarily a dispute with AfriEv. Where an organizer is responsible for a particular decision, you may need to resolve the matter directly with that organizer.

3. ACCEPTANCE OF THESE TERMS

You accept these Terms when you click "Accept", create an account, register for an event, purchase a ticket, access an event credential, scan a QR code, access an admin dashboard, or use AfriEv APIs. If you are using AfriEv on behalf of an organization, you represent that you have legal authority to bind that organization to these Terms.

4. ELIGIBILITY

You may use AfriEv only if you are legally capable of entering into a binding agreement. If you are under the age of contractual capacity, you may use services only with the authorization of a parent, guardian, school, or authorized institution.

5. DEFINITIONS

• "AfriEv": The platform, software, website, applications, APIs, services, and technology operated by the applicable AfriEv entity under Sfaret Technologies.
• "User": Any person accessing or using AfriEv.
• "Organizer": A person or organization using AfriEv to create or administer an event.
• "Attendee": A person registered or invited to participate in an event.
• "Event": A physical, virtual or hybrid activity managed through AfriEv.
• "Credential": A ticket, badge, QR code, digital pass, certificate, or accreditation identifier.
• "Content": Text, images, photos, videos, audio, documents, logos, data, and materials.

6. CHANGES TO THE SERVICES

AfriEv may add, modify, suspend or discontinue features from time to time due to technical improvements, security requirements, legal obligations, or infrastructure updates. Where a change materially affects paid contractual services, AfriEv will seek to provide reasonable advance notice.

7 – 9. ACCOUNTS, SECURITY & ORGANIZER PERMISSIONS

Account Registration (Sec 7): You agree to provide accurate information and never impersonate others or create deceptive accounts.

Account Security (Sec 8): Users are responsible for safeguarding passwords, using multi-factor authentication, and promptly reporting suspected compromise.

Organizer Accounts (Sec 9): Organizations are responsible for selecting, monitoring, and revoking administrative credentials for their staff.

10 – 12. EVENT CREATION, RESPONSIBILITY & CONTENT

Event Creation (Sec 10): Organizers configure dates, capacity, registration, ticket tiers, speakers, sponsors, and access rules.

Organizer Responsibility (Sec 11): The organizer is legally responsible for event safety, permits, venue compliance, staff conduct, and lawful execution.

Event Content (Sec 12): Organizers must not publish fraudulent, deceptive, infringing, defamatory, or unlawful materials.

13 – 20. TICKETS, PAYMENTS, REFUNDS & ACCESS

• 13 – 14. Ticket Purchases: Before purchase, attendees must review event venue, time, refund terms, and access restrictions. Online terms must be clear and disclosed prior to payment per FCCPC consumer protection guidance.
• 15 – 17. Prices & Payments: Prices may be in NGN, USD, GBP, or EUR. Payments are processed through authorized PCI-compliant payment gateways.
• 18. Refunds: Governed by the organizer’s disclosed refund policy and mandatory provisions of the Federal Competition and Consumer Protection Act 2018 (FCCPA).
• 19. Event Cancellation: The organizer is responsible for notifying attendees and administering refunds for cancelled or rescheduled events.
• 20. Event Access: Entry may be refused if tickets are fraudulent, duplicate, or attendee violates venue safety rules.

21 – 25. QR CODES, CREDENTIALS & CERTIFICATE INTEGRITY

QR Codes & Credentials (Sec 21–22): Used for admission and session attendance. Users must not counterfeit, duplicate, or tamper with validation hashes.

Certificates & Fraud Prevention (Sec 23–24): AfriEv provides digital issuance and public verification. The issuing organization is responsible for verifying the underlying achievement. Counterfeiting or falsifying credentials is strictly prohibited and subject to immediate revocation.

Attendance Records (Sec 25): Check-in timestamps and attendance logs are maintained for organizational reporting.

26 – 28. DATA PROTECTION, PRIVACY & COOKIES

Organizers must process participant information in compliance with the Nigeria Data Protection Act 2023 (NDPA). All processing is governed by the AfriEv Privacy Policy and Cookie Policy.

29 – 35. ACCEPTABLE USE & TERMINATION

Acceptable Use (Sec 29): You must not use AfriEv for fraud, financial crimes, malware distribution, hacking, unauthorized scraping, or deceptive schemes.

Prohibited Events (Sec 30): Events promoting illegal gambling, trafficking, extremist violence, or illicit substances are banned.

Suspension & Termination (Sec 32–35): AfriEv reserves the right to suspend or terminate accounts for material breaches, fraud, or non-payment.

36 – 39. INTELLECTUAL PROPERTY & TRADEMARKS

AfriEv retains all rights to its software, source code, databases, and trademarks. Users retain ownership of content they upload, granting AfriEv a license to host and display it for event administration.

40 – 49. THIRD PARTIES, APIS, SAFETY & ROLES

• 40 – 42. Third Parties & APIs: API consumers must respect rate limits, secure API keys, and adhere to security guidelines. Penetration testing without authorization is prohibited.
• 43 – 44. Event Safety & Accessibility: Physical venue safety, emergency medical plans, and accessibility accommodations remain the responsibility of the event organizer.
• 45 – 47. Sponsors, Volunteers & Speakers: AfriEv does not create employment or contractual liability between volunteers, sponsors, and organizers.
• 48 – 49. Feedback & Confidentiality: User suggestions may be utilized to improve the platform without compensation.

50 – 55. WARRANTIES, LIABILITY & CONSUMER RIGHTS

Warranties (Sec 50–51): Provided on an "as available" basis. AfriEv does not guarantee ticket sales volume or commercial event success.

Limitation of Liability (Sec 52): To the maximum extent permitted by law, AfriEv is not liable for indirect or consequential losses.

Consumer Rights (Sec 53): Nothing removes non-waivable statutory rights under the Federal Competition and Consumer Protection Act 2018 (FCCPA).

Indemnification & Force Majeure (Sec 54–55): Commercial organizers indemnify AfriEv against third-party claims arising from unlawful event operations. AfriEv is excused from delays caused by force majeure events.

56 – 59. COMPLAINTS, DISPUTES & GOVERNING LAW

Complaints (Sec 57): Submit concerns to complaints@afriev.com.ng. Complaints are reviewed under our internal dispute protocol and statutory FCCPC standards.

Governing Law (Sec 59): Governed by the laws of the Federal Republic of Nigeria (Rivers State / Federal High Court Jurisdiction), without limiting mandatory international consumer protections.

60 – 74. INTERNATIONAL, COMPLIANCE & CONTRACT TERMS

• 60 – 63. Compliance & AML: Governed by export laws, anti-money laundering (AML), and fraud detection standards.
• 64. Taxes: Users and organizers are responsible for applicable VAT or transaction taxes.
• 65 – 67. Electronic Communications: Electronic confirmations, checkboxes, and digital signatures constitute binding agreement.
• 68 – 74. Contract Integrity: Provisions include severability, non-waiver, order of precedence, and assignment rules.

75 – 85. SUBSCRIPTIONS, BILLING & RESPONSIBLE DISCLOSURE

• 76. No Resale: Reselling platform access without an enterprise partner agreement is prohibited.
• 77 – 79. Availability & Beta: Beta features are provided for testing. Enterprise uptime SLAs are governed by commercial agreements.
• 80. Responsible Disclosure: Report security vulnerabilities to security@afriev.com.ng.
• 81 – 85. Subscriptions & Billing: Outlines billing cycles, renewals, and free-tier service conditions.

86 – 96. SECTOR SPECIFIC GUIDELINES

Specific guidelines apply to Government Events (Sec 93), Educational Institutions (Sec 94), Churches and NGOs (Sec 95), Mobile Applications (Sec 90), and Open-Source Software (Sec 92).
